Most people in the Virginia eminent domain bar already know that the statewide eminent domain CLE is held at the Tides Inn in Irvington, Virginia, each year. The conference will be held at the same absolutely beautiful  venue again for this year, May 2-3, 2019. We expect the usual potpourri of interesting topics in takings, relocation, and inverse condemnation, presented by state, national, and this year international experts. Here are the scheduled sessions:

  • Compensability Issues: Median Breaks, Circuity, and Police Power
  • What is the Unit Rule? Is it constitutional?
  • Keynote Presentation: Avoiding Litigation in Eminent Domain: Ethical Considerations to Encourage Amicable Resolutions
  • Updates in the Law: Case and Code
  • Our Post-Karverly World: Is There a Formula for Finding Damages or Enhancement? Who Can Testify to Them?
  • How to Succeed in the Courtroom: A Judicial Perspective
  • Changes for Strict Compliance: Getting the Notice, Offer, Certificate, and Petition Correct
  • Valuing Natural Gas Pipelines: Creating Solutions to Differences
  • Just Compensation: Basic Concepts for Eminent Domain Valuation
  • Filling Out the Picture: Using Peripheral Experts to Support Appraisal Testimony
  • Inverse Condemnation: Procedural Traps and Claim Preservation
  • Jury Instructions: Time for a New Model?
  • Ethics: Ethically Trying Condemnation Cases in Virginia

The full agenda along with the speakers is available here, and the link for registration is available here. My partner Dave Arnold and I will both be speaking, and perhaps most importantly, the private cocktail reception for the conference is being sponsored by RightOfWay.law and Pender & Coward, so stop by and have some drinks on our nickel and say hi. We’d love to see you there!
