When we launched a brand-new podcast in August of last year designed for people with an interest in the right-of-way industry, who would of thought it would have come this far this fast? The Pendulum Land Podcast is now in its second season and in the Top 100 on iTunes!

We at RightofWay.law are particularly proud of this week’s episode on the podcast, Inverse Condemnation of Oysters, Oyster Leases and Oyster Beds. Say What??? “starring” your constant editor here at RightofWay.law, i.e. me, and illustrious internet sensation and Spam fanatic Robert Thomas of www.inversecondemnation.com fame. This episode examines the recent Virginia Supreme Court case we have talked about before on RightofWay.law, Johnson v. City of Suffolk and Hampton Roads Sanitation District which involved whether two Virginia agencies had inversely condemned leased oyster grounds under the Nansemond River because of alleged discharges of fecal coliform bacteria. The Pacific Legal Foundation wrote an amicus brief on behalf of the plaintiffs, and since Robert Thomas has recently joined the Pacific Legal Foundation, he covered the plaintiff’s position for the episode. I argued the case before the Virginia Supreme Court on behalf of the municipal defendant, and we had a fascinating discussion of the issues in the case.

And incidentally we also had an absolutely delicious lunch of oysters at the Atlantic on Pacific in Virginia Beach, so if you are ever in Virginia Beach please do make sure to give them a try. Amazing seafood, wonderful atmosphere including vintage photograph of oystermen on the walls, and a lovely and gracious staff. Absolutely top notch.
